Welcome to Club Sudo Terms and conditions

Introduction

This document sets forth the terms and conditions (the "Terms") governing the use of the services (the "Services") provided by Club Sudo Inc (the "Service Provider") to you (the "User"). By accessing, using, or availing of the Services, the User agrees to be bound by these Terms, which form a legally binding contract between the Service Provider and the User. These Terms are applicable to all users of the Services, including without limitation, users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms carefully before accessing or using our Services. By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms are considered an offer by the Service Provider, acceptance is expressly limited to these Terms.

The Services are offered and available to users who are 18 years of age or older. By using the Services, you represent and warrant that you are of legal age to form a binding contract with the Service Provider and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services.

Acceptance of Terms

By accessing or using the Services provided by Club Sudo Inc ("Service Provider"), you ("User") agree to be bound by these Terms. These Terms constitute a legally binding agreement between the User and the Service Provider regarding the use of the Services. If you do not agree to these Terms, you must not access or use the Services.

These Terms may be amended or updated by the Service Provider from time to time without notice. It is your responsibility to review these Terms periodically for any changes. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

Account Creation and Responsibility

In order to access and use the Services provided by the Service Provider, the User is required to create an account. The User agrees to provide accurate, current, and complete information during the account creation process and to update such information to keep it accurate, current, and complete. The Service Provider reserves the right to suspend or terminate any account that is suspected to contain inaccurate, not current, or incomplete information.

The User is responsible for maintaining the confidentiality of their account login information and for all activities that occur under their account. The User agrees to immediately notify the Service Provider of any unauthorized use of their account or any other breach of security. The Service Provider will not be liable for any loss or damage arising from the User's failure to comply with this section.
You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account. You are strictly prohibited from the possession of multiple Club Sudo accounts, including accounts with varying account holder names, email addresses, phone numbers or physical addresses. Club Sudo reserves the right to merge such accounts without prior warning. Duplicate accounts that have been used to gain access to promotions or offers that would not have been available to the account holder had they not been in possession of multiple accounts will be charged for the full value of services received without prior warning.

Member Services and Policies

This clause outlines the policies and procedures regarding the use of services offered by Club Sudo Inc ("Service Provider") to the User. By accessing, using, or availing of the Services, the User agrees to comply with the following terms:

1. Class Booking and Cancellations: Membership plans will be charged a $30 fee for no shows and $30 for any late cancellations. Class/Session Packages will be charged a ‘loss of credit’ for a no show or a late cancellation. This includes switching time slots within the 12-hour notice time period for Reformer Pilates classes and a 6-hour notice time period for Contrast Therapy. You can cancel online, in our app or by calling the club. If you have any questions or comments, please feel free to contact us at info@clubsudo.com.

2. Reservations: Reservations for classes are made on a first-come, first-served basis. Users are encouraged to book early to secure their spot. The Service Provider reserves the right to cancel or reschedule classes at any time. You must be physically present and checked in at the start of your scheduled class or your spot may be given to a waitlisted client. You understand that should a system error arise that results in the booking of a service with an ineligible membership or credit type, Club Sudo reserves the right to cancel your reservation.

3. Personal Belongings: Users are responsible for their personal belongings while on the premises of the Service Provider. The Service Provider is not liable for any lost, stolen, or damaged personal items.

4. Refunds and Cancellations: Membership fees and class passes are non-refundable except in specific circumstances as outlined in the Terms. Membership cancellations must be submitted in writing at least 7 days prior to the next billing cycle.

5. Membership Freezes: Monthly memberships can be frozen for a period of 30 days once per year for any reason. To initiate a freeze, written notice must be provided via email to info@clubsudo.com at least 7 days prior to the intended membership freezing period. Any additional freezes will incur a $50 fee, unless it is due to a medical reason with a doctor’s note provided.

6.⁠ ⁠Membership Commitment and Early Cancellation
All monthly memberships come with a minimum three (3) month commitment. If a member chooses to cancel their membership before fulfilling this 3-month term, a $100 early cancellation fee will apply. This fee will be automatically charged to the payment method on file at the time of cancellation. Requests for cancellation must be submitted in writing to info@clubsudo.com at least 7 days prior to the next billing cycle. No exceptions will be made unless due to medical reasons supported by a valid doctor’s note.

Club Rules and Regulations

In accordance with the Terms, the following rules and regulations are established to ensure a safe, respectful, and enjoyable environment for all Users of the Services provided by the Service Provider. Compliance with these rules is mandatory for all Users:

1. Attendance: Users should arrive and be ready to participate in their booked sessions at least 10 minutes prior to the start time. Late arrivals may not be accommodated, and no refunds or credits will be issued for missed sessions.

2. Studios: Users must respect the equipment, facilities, and other Users within the studio spaces. Any damage to property caused by a User's actions will be the responsibility of the User to repair or replace. If recovering from injury or illness, notify the instructor prior to the class start time. Phones are not permitted within fitness studios. Reformer Pilates equipment is to be used as directed. Do not enter studios while class is in progress.

3. Credits, Discounts, and Promotions: All credits, discounts, and promotions must be used in accordance with their specific terms and conditions. They cannot be combined with other offers unless explicitly stated. Special offers, discounts, promotions, or discount codes cannot be combined. Certain credit packs and discount codes are made available for first-time customers only. A first-time customer is defined as any person who has never taken a class at Club Sudo. This includes, but is not limited to, introductory packages, Influencer promotional codes, or other marketing and promotional offers. The creation of multiple accounts to gain access to discounts or promotions is strictly prohibited. Duplicate accounts and accounts in breach of this policy are subject to a rectification fee. The company conducts regular verifications, and should the company become aware of violations of this policy, the customer will be charged without warning for the full value of all products for which invalid discounts were received. All purchases will be non-refundable. Repeat violation of the discount and promotions policy will result in the cancellation of the customer’s account.  A Reformer Pilates credit can be used to book any reformer pilates class and a Contrast Therapy credit can be used to book any session in our contrast therapy section of the facility. If you are on a monthly membership and wish to purchase additional credits, you may do so at the same rate as your membership daily pricing rates. Credits can be used to book services for people other than the account holder.

1. Alcohol: The consumption of alcohol is strictly prohibited in all studio spaces and during classes. The Service Provider reserves the right to refuse service to any User under the influence of alcohol.

2. Saunas: You must be at least 13 years of age to use the saunas. Please shower before entering saunas. Do not pour water on any part of the sauna. No food or drinks are allowed inside the sauna. No drying of personal items in the sauna is permitted. Due to high temperatures, the sauna could be dangerous to your health. We recommend that you consult a physician before you use the sauna. Those with medical conditions such as high blood pressure, heart disease, and respiratory problems, and those who are pregnant, should avoid exposure to high heat..

3. Class Booking and Cancellations: You must cancel class at least 12 hours in advance for Reformer Pilates and at least 6 hours in advance for Contrast Therapy – which includes the sauna, cold plunge, tea/fireplace lounge. Failure to cancel a booking within that time frame will result in a deduction of a package credit.

4. Reservations: You must be physically present and checked in at the start of your scheduled class or your spot may be given to a waitlisted client. You understand that should a system error arise that results in the booking of a service with an ineligible membership or credit type, Club Sudo reserves the right to cancel your reservation.

5. Personal Belongings: The Service Provider is not responsible for lost, stolen, or damaged personal belongings brought onto the premises. Users are encouraged to keep valuables secure and to use designated storage areas where available.

6. Refunds and Cancellations: Refund and cancellation policies are as specified in the Terms. Users wishing to cancel their membership or request a refund must follow the procedures outlined therein.

6. Membership Freezes: Monthly memberships can be frozen for a period of 30 days once per year for any reason. To initiate a freeze, written notice must be provided via email to info@clubsudo.com at least 7 days prior to the intended membership freezing period. Any additional freezes will incur a $50 fee, unless it is due to a medical reason with a doctor’s note provided. This does not include involuntary freezes, such as studio closures. In the case of an injury, you can request to freeze your membership for the duration of the injury with a doctor’s note. In the case of pregnancy, you can request to freeze your membership for the duration of your pregnancy with a doctor’s note up to 12 months. You must provide a minimum of seven (7) days’ notice to ensure your account is not automatically charged. Please contact us at info@clubsudo.com to put your account on hold. Upon the provision of a doctor’s note, extensions may be made in the case of long-term illness or pregnancy.

Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, services purchased or obtained or messages received or transactions entered into through or from the Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Services; or (v) any other matter relating to the Services.

Notwithstanding any damages that the User might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of the Service Provider under any provision of these Terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by the User for the Services during the three (3) months period prior to the act giving rise to the liability.

The limitations on liability contained herein shall apply whether the damages arise from use or misuse of and reliance on the Services, from inability to use the Services, or from the interruption, suspension, or termination of the Services (including such damages incurred by third parties). This limitation shall also apply with respect to damages incurred by reason of other services or goods received through or advertised on the Services or received through any links provided in the Services, as well as by reason of any information or advice received through or advertised on the Services or received through any links provided in the Services. This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services, lost profits, or lost data. Such limitation shall further apply with respect to the performance or non-performance of the Services or any information or merchandise that appears on, or is linked or related in any way to, the Services provided by the Service Provider.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such jurisdictions, the Service Provider's liability is limited to the greatest extent permitted by law.

Minor Participation

In accordance with the laws of Ontario, the Service Provider requires all Users who are minors (individuals under the age of 18) to have consent from a parent or legal guardian in order to access and use the Services. Such consent must be provided in writing and acknowledge the acceptance of these Terms on behalf of the minor.

Parents or legal guardians providing consent are required to create an Account in their own name, through which the minor's access to the Services will be managed. The parent or legal guardian assumes full responsibility for the minor's compliance with these Terms and any other policies set forth by the Service Provider, including but not limited to Class Booking and Cancellations, Reservations, Personal Belongings, Refunds and Cancellations, Membership Freezes, Attendance, Studios, Credits, Discounts, and Promotions, Alcohol, and Saunas.

Furthermore, the Service Provider reserves the right to require proof of age at any time to verify that Users meet the minimum age requirement for certain Services or access to certain areas within the Studios. Failure to provide such proof may result in the suspension or termination of the User's access to the Services.

Medical Disclaimer

The Services provided by the Service Provider are not intended to be, and must not be taken as, a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the Service Provider's website or received through the Services.

The Service Provider does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on its website or through the Services. Reliance on any information provided by the Service Provider, its employees, others appearing on the website at the invitation of the Service Provider, or other Users of the Services is solely at your own risk.

In no event shall the Service Provider be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, that arises out of or is in any way connected with any use of the Services or content found herein, the operation of the website, or any failure or delay in the operation of the website (including, but not limited to the inability to use any component of the website for reservations or ticketing).

Assumption of Risk

By agreeing to the Terms, the User acknowledges and accepts that participation in and access to the Services may involve inherent risks, including but not limited to personal injury, illness, or in extreme cases, death. The User expressly assumes all risks associated with their participation in any and all activities, services, or use of facilities provided by the Service Provider. This assumption of risk extends to all aspects of the User's engagement with the Service Provider, including but not limited to the use of equipment, participation in activities, and presence on the premises where the Services are provided.

The User further acknowledges that the Service Provider has made no representations or warranties, express or implied, regarding the safety of the activities, services, or facilities. It is the User's responsibility to ensure that they are physically and medically fit to participate in the Services and to understand the extent of their participation and the associated risks. The User agrees to comply with all safety and health guidelines and instructions provided by the Service Provider and to use any protective equipment or clothing that may be required.

In consideration of being allowed to participate in and access the Services, the User hereby releases, waives, discharges, and covenants not to sue the Service Provider, its officers, directors, employees, agents, and affiliates, from any and all liabilities, claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the negligence of the Service Provider or otherwise, including negligent rescue operations. This release and waiver extend to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown.

The User agrees that this Assumption of Risk clause is intended to be as broad and inclusive as permitted by the laws of Ontario and that if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Release and Indemnification

In consideration of being allowed to participate in and access the Services, the User agrees to release and forever discharge Club Sudo Inc, its affiliates, officers, directors, employees, agents, and successors from any and all claims, demands, rights, promises, damages, and liabilities arising out of or in connection with the User's use of the Services, including any injuries, loss, or damage that might be sustained by the User or their property.

Furthermore, the User agrees to indemnify, defend, and hold harmless Club Sudo Inc and its affiliates, officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with the User's access to, use of, or alleged use of the Services, or the User's violation of the Terms.

This Release and Indemnification clause shall be governed by and construed in accordance with the laws of Ontario, without giving effect to any principles of conflicts of law.

Copyright

All content, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, appearing on the Website or related to the Services provided by Club Sudo Inc (Service Provider), is the property of the Service Provider or its content suppliers and is protected by Canadian and international copyright laws. No part of the content may be copied, reproduced, downloaded, posted, transmitted, or distributed in any form or by any means without the prior written consent of the Service Provider.

The User is granted a limited, non-exclusive, non-transferable license to access and use the Services and associated content for personal, non-commercial purposes as set forth in the Terms. This license does not include any resale or commercial use of the Services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Services or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

Mobile Services
The Service Provider offers mobile services ("Mobile Services") to the User, enabling access to Services and features through a mobile device. These Mobile Services are subject to the following terms:

• The User must have a compatible mobile device and internet access to use the Mobile Services.
• The use of Mobile Services may incur data charges from the User's mobile service provider. The User is responsible for any such charges.
• The Service Provider does not guarantee that Mobile Services will be compatible with all mobile devices or that it will be available in all geographic locations.
• The User agrees to receive communications from the Service Provider related to the Mobile Services on their mobile device. These communications may include notifications, alerts, and updates.
• The Service Provider reserves the right to modify, suspend, or discontinue the Mobile Services at any time without notice to the User. The Service Provider will not be liable to the User or any third party should it exercise such rights.
• The User must comply with all applicable laws and regulations in their jurisdiction when using the Mobile Services.
• Any information provided by the User in connection with the Mobile Services must be accurate, current, and complete.

By using the Mobile Services, the User agrees to be bound by these terms in addition to the Terms.

Termination

This Agreement may be terminated by either party under the following conditions:

1. By the User: The User may terminate this Agreement at any time by providing written notice to the Service Provider. Upon termination, the User shall cease to use the Services and uninstall any related software or applications.

2. By the Service Provider: The Service Provider may terminate this Agreement at any time without notice if the User breaches any terms of this Agreement, engages in conduct that the Service Provider deems harmful to its operations, reputation, or relationships, or for any other reason at the sole discretion of the Service Provider. In such cases, the Service Provider reserves the right to immediately deactivate or delete the User's Account, as well as all related information and files in the Account.

3. Automatic Termination: This Agreement will automatically terminate without notice if the Service Provider ceases to operate the Services or if the Services are no longer legally available in the jurisdiction of Ontario.

Upon termination, all rights granted to the User under this Agreement will immediately cease, including access to the Services. The Service Provider is not liable for any damages or losses suffered by the User as a result of termination in accordance with this clause.

Governing Law

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of Canada or the courts of the Province of Ontario in each case located in the city of Toronto and County of York. Each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding.

Changes to this Agreement

The Service Provider reserves the right, in its sole discretion, to modify or replace any part of these Terms at any time, without prior notice to the User. Such changes will become effective immediately upon posting on the Website or notification to the User through other means. It is the User's responsibility to check these Terms periodically for changes. The User's continued use of the Services following the posting of any changes to these Terms constitutes acceptance of those changes.

The Service Provider may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the current Terms.

If the User does not agree to any changes to these Terms, the User must stop using the Services immediately. By continuing to use the Services after changes are made, the User agrees to be bound by the revised Terms.

Arbitration

In the event of any dispute, claim, question, or disagreement arising from or relating to the Terms or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If they do not reach such solution within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, or disagreements shall be finally settled by arbitration administered by the Arbitration Association of Ontario under its Commercial Arbitration Rules, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

The arbitration shall be conducted in the English language, in the city of Toronto, Ontario, Canada, and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The arbitrator's decision shall be final and binding on the parties, and the parties agree to be bound thereby and to act accordingly. The costs of the arbitration, including administrative fees, the arbitrator's fees, and all other fees and costs, shall be shared equally by the parties.

Notwithstanding the foregoing, each party retains the right to seek injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.Inc. Please carefully read these Terms of Service (the “Terms”) before using our website located at www.clubsudo.com (the “Site”) or participating in our services (collectively, the “Services”). By accessing, browsing, or utilizing any part of this Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

.1. ACCOUNTS
To access certain features of the Site or Services, you must create a Club Sudo account. You agree to:• Provide accurate, current, and complete information during the registration process.
• Maintain the confidentiality of your account password and restrict access to your account.
• Notify us immediately of any unauthorized use of your account or any other breach of security.
Creating multiple accounts is strictly prohibited. We reserve the right to terminate any accounts found to be in violation of this policy without refund.

2. MEMBERSHIP

POLICIES
Class Booking & Cancellations
• You must cancel your class reservation at least 12 hours in advance to avoid losing the credit associated with that class.
• For memberships classes, a $30 for late cancellations and no-shows may apply.
Refunds & Membership Freezes
• All membership fees are generally non-refundable, except as required by law.
• You may request to freeze your membership for a total of up to 14 days every six months, with a maximum of two freezes in a 12-month period. Please provide at least three days’ notice for freezes.
• Exceptions to the 14-day limit may be made for long-term illnesses or pregnancy upon submission of a doctor’s note.

Refund Policy
• All class passes, memberships, and juice bar purchases are non-refundable.
• Retail items can be returned within 30 days of purchase for a full refund if unused and in original packaging. Items purchased on sale or at a discounted rate are non-refundable.

3. CLUB REGULATIONS

Attendance
• Arrive on time for classes and sessions. Late arrivals (beyond 3 minutes after the start time) may not be permitted entry.
• You must check in physically at the front desk or use the self-check-in feature before entering the Reformer Pilates studio or Contrast Therapy
Personal Items
• Club Sudo is not responsible for personal belongings left unattended. You assume all risks associated with your property.
• Lockers are for session use only; items left overnight may be disposed of or donated.

Contrast Therapy Usage
• The lounge area is available for members to relax during classes. Please maintain a respectful and quiet environment.
• You must be at least 13-16 years of age (with guardian attendance) to use the Reformer Pilates, Sauna and Cold Plunge facilities or age allowed by law. We recommend consulting with a physician before using these facilities, especially for individuals with underlying health conditions.

Behavior & Conduct
• We strive to create a respectful and welcoming atmosphere. Harassment of any kind—verbal, physical, or visual—is not tolerated.
• Violations of our code of conduct can result in immediate removal from the premises and cancellation of your membership without refund.

4. LIABILITY WAIVER
By using our Services and facilities, you acknowledge:• The inherent risks involved in physical activities, such as reformer pilates, breath work classes, and using sauna and cold plunge facilities.
• To hold harmless Club Sudo and its employees from any claims arising from injuries or damages incurred while utilizing our facilities.
• Consultation with a physician is recommended before engaging in any fitness program or using our services, especially if you have underlying health conditions.

5. JUICE BAR AND NUTRITION
• To enjoy our juice bar services, you must be considerate of any dietary restrictions or allergies. It is your responsibility to inform our staff of any concerns.
• All juice bar sales are final. We do not accept returns or refunds on any food or beverage purchases.

6. INTELLECTUAL PROPERTY
Content on the Club Sudo Site, including logos, text, images, videos, and associated materials (the "Content"), is protected under copyright and trademark laws. You may not copy, use, or distribute any Content without our express written consent.

7. MOBILE SERVICES
Our Site and Services may offer mobile functionalities, such as:• Booking classes, scheduling appointments for the Contrast Therapy/Breathwork and Reformer Pilates
• Receiving and replying to messages via SMS, MMS, or other electronic means.
• Browsing Club Sudo’s services from your mobile phone.
Note that your mobile carrier’s standard messaging and data rates will apply. It is your responsibility to verify with your carrier regarding these charges and any restrictions on mobile services.

8. TERMINATION
We reserve the right to terminate your access to the Site or Services at any time, without notice, for violations of these Terms or for any other reason deemed necessary by Club Sudo. Upon termination, access to your account and any associated Services will cease immediately.

9. DISPUTE RESOLUTION AND ARBITRATION
Any disputes arising from these Terms or your use of the Site or Services shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority. Both you and Club Sudo agree that any claims must be brought individually and not as part of a class action.If a dispute arises, you agree to provide written notice to Club Sudo to attempt to resolve the issue informally before pursuing arbitration.

10. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. Any legal actions or proceedings arising out of these Terms will be conducted in the courts located in Ontario.

11. CHANGES TO TERMS

By signing up for and attending our classes or utilizing our services (including but not limited to Reformer Pilates and Contrast Therapy/Breathwork), you acknowledge that you are voluntarily participating in activities that involve physical exertion. 14. LIMITATIONS OF LIABILITY
To the fullest extent permitted by law, Club Sudo Inc. ("Club Sudo") and its directors, officers, employees, agents, representatives, and affiliates (collectively, "we," "us," or "our") shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the Site or Services. This includes, but is not limited to:• Loss of Profits or Revenues: We are not responsible for any lost profits or revenues you may incur as a result of your use of our Site or Services.
• Physical Injury or Health Issues: Participation in fitness activities, including but not limited to reformer pilates, sauna usage, cold plunge, and breath work classes, carries inherent risks. Club Sudo is not liable for any injuries, including but not limited to, personal injury, heart attack, stroke, or death, that may occur during or after participation in these activities. By participating, you acknowledge you understand these risks and assume full responsibility.
• Member Responsibilities: You agree to take all necessary health precautions before participating in any fitness activity, including consulting with a physician. You are responsible for ensuring that you are in sufficient health to participate in such activities.
• Damages From Your Actions: Club Sudo is not responsible for any damages caused by your failure to comply with any health and safety instructions provided by staff or any failure to adequately supervise minors or others using the facilities and services.
• Equipment and Facility Usage: Club Sudo does not warrant that its facilities and equipment will be free from defects or errors. You assume all responsibility for the risks associated with the use of any equipment and facilities, including but not limited to, any malfunctions or failures that may occur.
• Third-Party Links and Services: Our Site may contain links to external third-party websites and services. These third-party sites are not owned or controlled by Club Sudo, and we assume no responsibility for the content, privacy policies, or practices of any such sites or services. You acknowledge that we are not responsible for any damages incurred as a result of your interactions with those sites or services.
• General Disclaimer: This limitation applies regardless of whether the liability arises from contract, tort, negligence, strict liability, or any other legal theory. If you reside in a jurisdiction that does not allow the exclusion or limitation of liability for consequential or incidental damages, then the liability of Club Sudo shall be limited to the maximum extent permitted by law.

By entering Club Sudo premises, you acknowledge and agree that we may capture photographs and/or video recordings for marketing, promotional, or internal use. These may be used on our website, social media platforms, or other marketing channels. If you prefer not to be featured, please notify our team upon arrival.
